These terms govern your use of clearbagsmarket.com and any purchase you make from us. The site is operated by Chafai Services LLC, a Missouri limited liability company trading as ClearBagsMarket. By using the site or placing an order, you agree to these terms.
1. Who can order
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. By ordering you confirm the information you give us is accurate and that you are authorized to use the payment method you provide.
2. Products, descriptions and images
We describe our products as accurately as we can and photograph them under normal lighting. Clear vinyl, TPU and PVC photograph differently depending on the screen you are viewing them on, so small variations in tint and clarity between the photo and the item you receive are normal and are not a defect.
Measurements are approximate. Bags are hand-measured and may vary by up to half an inch (±0.5") in any dimension. If exact dimensions matter for your purpose, order early and check the bag before the event.
3. Stadium, venue and workplace clear-bag policies
Many of our products are designed to meet common clear-bag requirements, including the widely used 12" x 6" x 12" standard. We cannot guarantee that any bag will be admitted to any specific venue.
Venues, schools, stadiums and employers set their own rules, change them without notice, and enforce them at the discretion of staff on the day. Size limits, material requirements and exceptions vary widely. Before your event, check the current published policy of the venue you are attending and compare it against the product dimensions on our page, allowing for the ±0.5" tolerance above.
Refused entry to a venue is not a defect in the product. That said, if a bag is genuinely a different size than we advertised, that is our error and our standard return policy applies.
4. Pricing and errors
Prices are shown in the currency selected at checkout and may change at any time before you order. We try hard to avoid mistakes, but if a product is listed at an obviously incorrect price or with an incorrect description, we reserve the right to cancel the order and refund you in full, even after the order is confirmed. We will contact you before doing so.
5. Orders and acceptance
Your order is an offer to buy. Our confirmation email acknowledges receipt but does not accept your order — acceptance happens when we dispatch it. We may refuse or limit an order if the item is out of stock, if we suspect fraud, if the order appears to be for resale, or if we cannot ship to your address. If we cancel a paid order, you are refunded in full.
6. Payment
We accept payment through Shopify Payments and PayPal. Card details are handled directly by those processors and are never stored by us. You are responsible for any bank or currency conversion fees your provider charges.
7. Shipping and returns
Delivery times, shipping availability and customs charges are set out in our Shipping Policy. Returns, refunds, exchanges and cancellations are set out in our Refund & Return Policy. Both are part of these terms.
Risk of loss passes to you on delivery.
8. Intellectual property
All content on this site — text, product photography, graphics, logos, the ClearBagsMarket name and the site's layout — belongs to Chafai Services LLC or our licensors and is protected by copyright and trademark law. You may not copy, scrape, republish or use it commercially without our written permission. Nothing on the site grants you a license to any trademark.
9. Reviews and other content you submit
If you post a review, photo or comment, you keep ownership of it but grant us a worldwide, royalty-free, perpetual license to use, display and reproduce it in connection with our marketing. You confirm that the content is yours to give and does not infringe anyone else's rights. We may remove content that is unlawful, abusive, misleading or off-topic.
10. Acceptable use
You agree not to use the site to break any law, to introduce malware, to scrape or harvest data, to attempt to gain unauthorized access to our systems or accounts, to interfere with the site's operation, or to place fraudulent orders. We may suspend access for any of these.
11. Third-party links and services
The site links to and integrates with third-party services, including payment processors, analytics providers and social platforms. We are not responsible for their content, practices or policies. Their terms apply when you use them.
12. Disclaimer of warranties
The site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or secure.
Our products are fashion and utility accessories. They are not security equipment and are not represented as protective, weather-proof or tamper-proof.
13. Limitation of liability
To the fullest extent permitted by law, Chafai Services LLC is not liable for indirect, incidental, special, consequential or punitive damages — including lost profits, lost opportunities, missed events or denied venue entry — arising from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the product giving rise to that claim.
Some jurisdictions do not allow these exclusions, so they may not apply to you.
14. Indemnity
You agree to indemnify Chafai Services LLC against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the site.
15. Governing law and disputes
These terms are governed by the laws of the State of Missouri, United States, without regard to conflict-of-law rules.
Informal resolution first. If you have a dispute, email info@clearbagsmarket.com and give us 30 days to resolve it. Most problems are settled at this stage.
If that fails, you and Chafai Services LLC agree that any dispute will be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, seated in Missouri, rather than in court, and that neither party will bring a class action. You may bring an individual claim in small claims court instead if it qualifies.
Consumers in the EEA and UK are not bound by the arbitration and venue provisions in this section. You may bring proceedings in the courts of your country of residence, and you keep the full benefit of the mandatory consumer protection laws that apply there.
16. Changes to these terms
We may update these terms. The version in effect when you place an order is the one that applies to that order. Continued use of the site after an update means you accept the revised terms.
17. General
If any provision of these terms is found unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy, Shipping and Refund policies, are the entire agreement between us.
